Publishing Agreement Tropical Grasslands Online Journal

This Agreement is entered between the International Center for Tropical Agriculture (el Centro Internacional de Agricultura Tropical) – CIAT (hereinafter denominated as the Publisher) and the Author(s), where the Author(s) want the Publisher to publish their Work submitted to the journal and the Publisher wishes to publish such Work under the following terms:

 

1. Acceptance and Authority to Execute

By submitting a manuscript, the Author represents and warrants to have the authority and all the rights to execute this Agreement. If the Author’s institution or employer owns the copyright of the Work, it is likely that an authorized representative of the institution or employer should accept this Agreement. The Author must verify this with the organization or employer before proceeding.

Where an Author is acting on behalf of her/his organization, employer, or any other entity, the Author warrants that s/he is authorized to submit on behalf of the entity in question and grants the rights and accepts the obligations in this Agreement on behalf of such entity.

Each and all Authors (in case of a multi-authored manuscript) must endorse this Agreement. If is not endorsed by all Authors, the corresponding Author acknowledges that s/he is doing it on her/his own behalf and on behalf of all the Authors, with their authorization.

Acceptance of this Agreement is a pre-requisite for final acceptance of the Work and its publication in the online journal Tropical Grasslands-Forrajes Tropicales.

 

2. Author(s)’ Representations

As Author, you warrant and represent that the Work:

· is original;

· and all the data, evidence, facts and content are accurate and true;

· has not been published before (except if included in an institutional pre-print server);

· is not presently being considered for publication elsewhere;

· does not infringe any intellectual property right or proprietary right of any person or entity and its use in accordance with this Agreement will not infringe any of such rights;

· does not violate the right of privacy of any person;

· does not contain any subject matter that contravenes any laws (including defamatory material and misleading and deceptive material); and

· meets ethical standards applicable to the research discipline.

If the Work contains any material such as photos, images, tables, figures, data, etc., that you do not own or control, you must obtain permission to use it and submit evidence of such permission to the Publisher. As the Publisher will license the Work under the Creative Commons Attribution 4.0 International (CC BY 4.0) License, the third party owner must approve the use of such license to her/his content as part of your Work.

CIAT as the Publisher of Tropical Grasslands-Forrajes Tropicales reserves the right to remove any content of an article submitted to the journal such as photos, images, figures, tables, illustrations, data, audio and video files, and the like, whether before or after publication, as well

as the full article, if there is a reason to believe that the content included in your submission lacks permission from the owner of the content. You agree to indemnify, defend and hold harmless CIAT (the Publisher) against any claims in relation to any of the warranties above.

 

3. Rights of Publication

In consideration for publication of the Work, the Author grants to CIAT (the Publisher) a non-exclusive, irrevocable, royalty-free worldwide license to:

· reproduce, publish, distribute, transmit, store, translate, create derivative works from and communicate the Work, or any part of the Work, to the public in any and all forms, manner, format or media, whether existing before or after the date of this Agreement, for the purposes of publication, dissemination, indexing, archiving, preservation, educational use and other activities related to the operation and promotion of the journal, for the full remaining term of the copyright subsisting in the Work in each applicable jurisdiction, and in any renewal or extension thereof;

· reproduce, publish, distribute, transmit, store, translate, create derivative works from and otherwise use the supplemental materials, data, audio or video files that you have submitted for publication with your manuscript, granting CIAT the non-exclusive and royalty-free worldwide right to these supplemental materials, or any part of them in any and all forms, manner, format or media, whether existing before or after the date of this Agreement, for the full remaining term of the copyright subsisting in them in each applicable jurisdiction, and in any renewal or extension thereof;

· approve fair and reasonable permission requests from third parties to reuse material contained in the Work for the purpose of study, research or subsidiary publication.

Copyright in the Work remains with the Author (or, where applicable, the Author's employer, institution or other copyright owner).

The Publisher may publish, distribute, archive, preserve and make the Work available under the Creative Commons Attribution 4.0 International (CC BY 4.0) License.

 

4. Authors’ Rights

The Author retains copyright in the Work.

In addition to the Author’s moral rights in respect of the Work, you as Author retain the right to:

· Place the pre-publication version (not peer-reviewed) of the Work on a pre-print server.

· Place the pre-publication version (not peer-reviewed) of the Work on a personal website, institutional repository or any other online database or repository, provided that a link is included to the definitive published version on the Tropical Grasslands-Forrajes Tropicales website.

· After publication of the Work in Tropical Grasslands-Forrajes Tropicales, use, reproduce, distribute, communicate, adapt and otherwise exploit the Work as permitted under the

Creative Commons Attribution 4.0 International (CC BY 4.0) License, subject to the terms of that license.

· Use the Work or a portion of the Work as part of a larger work that you create (e.g. use figures in new journal articles or book chapters, use excerpts in new articles, book chapters, blog posts, or include the entire Work in a collection of your works), provided that appropriate credit is given to its first publication in Tropical Grasslands-Forrajes Tropicales.

· Authorize third parties to use, reproduce, distribute, adapt, translate, mine, analyze, or otherwise reuse the Work in accordance with the Creative Commons Attribution 4.0 International (CC BY 4.0) License.

· Use and permit others to use the supplemental materials for any purpose, provided that appropriate credit is given to their first publication in Tropical Grasslands-Forrajes Tropicales.

You as Author agree to:

· Not use the Work in any way that implies that the Publisher endorses any product, service, organization or procedure described in the Work.

· Ensure that any reuse of the Work appropriately acknowledges its original publication in Tropical Grasslands-Forrajes Tropicales and complies with the attribution requirements of the Creative Commons Attribution 4.0 International (CC BY 4.0) License.

 

5. Publisher’s Additional Acknowledgments and Commitments

The Publisher agrees to provide to Author within 15 days of first publication and at no charge, an electronic copy of the published Work in a format known or to be known, such as the Portable Document Format (.pdf), which preserves final page layout, formatting, and content. No technical restriction, such as security settings, will be imposed to prevent copying or printing of the document.

 

6. Acknowledgment of Prior License Grants

In addition, where applicable and without limiting the retention of rights above, the Publisher acknowledges that Author’s grant of non-exclusive rights under this Publication Agreement is subject to Author’s prior grant of a non-exclusive copyright licence to a funding entity that financially supported the research reflected in the Work as part of an agreement between the Author and such funding entity.

Nothing in this Agreement shall be interpreted as transferring ownership of copyright in the Work to the Publisher. Copyright shall remain with the Author (or, where applicable, the Author’s employer, institution or other copyright holder).

The rights granted to the Publisher under this Agreement are limited to those necessary to publish, distribute, preserve, archive, index and make the Work available to the public as part of the journal Tropical Grasslands-Forrajes Tropicales and under the Creative Commons Attribution 4.0 International (CC BY 4.0) License.

 

7. User Access and Rights

The Publisher shall make the final published version of the Work available immediately online, without any embargo period.

The Author retains copyright in the Work.

The Work shall be published under the Creative Commons Attribution 4.0 International (CC BY 4.0) License. Under this license, users may copy, distribute, transmit, adapt, translate, text and data mine, and otherwise use the Work for any lawful purpose, including commercial purposes, provided that appropriate attribution is given to the Author(s), a link to the license is provided, and any changes made are clearly indicated.

By accepting publication in the journal, the Author grants the Publisher a non-exclusive, irrevocable, royalty-free worldwide licence to publish, reproduce, distribute, archive, preserve, index and communicate the Work to the public as part of Tropical Grasslands-Forrajes Tropicales.

No provision of this Agreement shall be interpreted as transferring ownership of copyright in the Work to the Publisher.

8. Final Considerations

If the article is rejected, all rights granted to the Publisher under this Agreement revert to the Author and, where relevant, to the Author’s employer or parent organization. In such a case, this Agreement shall be null and void.

This agreement shall remain in effect throughout the term of copyright in the Work and may not be revoked without the express written consent of both parties.

This Agreement shall be governed, construed and enforced according to the general principles of international law to the exclusion of any national system of law, including the UNIDROIT Principles of International Commercial Contracts 2010. Disagreements between the parties concerning the interpretation or application of this Agreement shall be settled amicably by negotiation in the first instance, failing which all disputes arising out of or in connection with it shall be finally settled under the Rules of Arbitration of the International Chamber of Commerce by one or more arbitrators appointed in accordance with the said Rules
